By accessing or using the HardToSkip website and services, you agree to comply with and be bound by these Terms and Conditions and our Privacy Policy. These terms may be updated from time to time, and you are encouraged to review them periodically. Continued use of the Site after changes to the Terms and Conditions constitutes acceptance of those changes.

2. Service Overview

HardToSkip is a Software-as-a-Service (SaaS) platform that automatically generate videos from text.

3. Account Creation and Access

To access HardToSkip services, you must create an account by providing the following personal information:

  • Name
  • Email address (which will be verified via a verification email)
  • Password

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

4. Purchasing Credits and Credit Usage

HardToSkip operates on a credit-based system. Users can purchase credits as follows:

  • Credits last for 12 months from the date of purchase.
  • There is no monthly commitment; users top up their credit balance as needed.
  • Pricing and credit validity may change in the future.
  • Credits are used to generate videos, and you can monitor your credit balance and purchase history through the billing page on your account.

    5. Refund Policy

    Refunds for credits may be requested under the following conditions:

    • Failed video processing: If video captioning fails, users can contact [email protected] within 7 days of purchase for a refund for the credits used on that video.
    • Refund Process: Refund requests will be processed within a reasonable time, and users will receive their balance minus credits that have been used.

    Unused credits cannot be refunded after 7 days of purchase.

    6. Data Privacy and Security

    We take the privacy and security of your data seriously. The following outlines how we handle your personal and video data:

    • Payment Information: We do not store payment card details. All payment transactions are handled by Paddle, a third-party provider.
    • Credit and Transaction History: We track the credits you purchase, the date of purchase, and the expiration date of those credits.
    • Video and Metadata Storage: Videos, input text by the user and captions are stored separately, with metadata (such as video length, quality, and language) stored briefly for processing purposes. Processed videos are retained temporarily unless deleted by the user.
    • Audio Retention: Audio extracted from videos is temporarily stored and deleted within 24 hours after processing.
    • Data Encryption: All data is transmitted over a secure HTTPS connection. User data is stored securely in Europe.
    • Data Retention and Access: Data may be stored for up to 7 years for billing and regulatory purposes, after which it will be deleted.
    • User Rights: Users have the right to access, request deletion, or modify their personal data at any time. You may request your data by contacting us at [email protected].

    7. Account Deletion and Data Handling

    Account Deletion: Users can delete their account directly from their profile page. Upon deletion, all personal data, including processed videos, credits, and metadata, will be permanently deleted.

    Unused Credits: Unused credits will be deleted upon account deletion and cannot be refunded.

    8. Data Breaches and Notifications

    In the event of a data breach:

    • Notification: Users will be notified within 72 hours of identifying a breach, via email and possibly through announcements on social media.
    • Details Shared: The nature of the breach, affected data, and any relevant information will be disclosed.
    • User Assistance: We will provide guidance on how to protect your account, such as recommending password changes and monitoring for suspicious activity.

    9. Changes to the Privacy Policy

    Users will be notified of any changes to the Privacy Policy via email and through announcements on the website. Users will be given at least 30 days’ notice before these changes take effect. You may be required to review and accept updated policies upon logging in.

    10. Service Availability

    We strive to ensure that our services are available at all times, but we do not guarantee uninterrupted access. Scheduled maintenance or unforeseen issues may cause temporary service disruptions. We will notify users of major service disruptions in advance when possible.
