Terms and Conditions
These terms govern access to HardToSkip and the content creation and publishing tools available through the service.
1. Agreement
By creating an account, using HardToSkip, or initiating an upload, you agree to these Terms and Conditions and our Privacy Policy. If you use the service for an organization, you confirm that you are authorized to bind that organization.
2. The service
HardToSkip provides tools that assist with planning, generating, editing, reviewing, downloading, scheduling, and publishing social content. Features may change as the service is improved. Generated content is a draft and is not guaranteed to achieve views, engagement, revenue, search ranking, or virality.
3. Accounts and security
You must provide accurate account information, keep credentials secure, and promptly report unauthorized access. You are responsible for actions taken through your account and connected channels unless caused by a failure for which HardToSkip is legally responsible.
4. Your content and instructions
You retain your rights in content you submit and final content created for you, subject to rights held by third parties. You grant HardToSkip a limited license to host, process, transform, transmit, and display content only as needed to provide, secure, and improve the user-facing service.
You confirm that you have the rights, licenses, consents, and lawful basis needed for uploaded media, names, likenesses, voices, music, trademarks, and instructions. You are responsible for reviewing content for accuracy, intellectual property, privacy, advertising, platform, professional, and industry requirements before publication.
5. YouTube connection and uploads
HardToSkip uses YouTube API Services. By using YouTube features, you also agree to be bound by the YouTube Terms of Service. Google’s handling of information is described in the Google Privacy Policy.
You choose whether to connect a YouTube channel. Before each upload, you control the video title, description, visibility, and Made for Kids setting. You must deliberately start the upload. HardToSkip will not silently modify those approved values before sending them to YouTube.
By clicking the final YouTube upload action, you certify that the content complies with the YouTube Terms of Service, including the YouTube Community Guidelines, and that it does not violate another person’s copyright or privacy rights.
You may disconnect the channel in HardToSkip or revoke access through Google’s third-party connections page.
6. AI-assisted features
HardToSkip uses Google Gemini and OpenAI models in AI-assisted workflows. AI can misunderstand source material, omit context, produce inaccurate captions, or suggest unsuitable creative choices. You must review every output before relying on or publishing it. Do not use AI output as medical, legal, financial, or other professional advice.
7. Credits, fees, and cancellation
Paid features may consume credits or incur fees shown in the product. Unless required otherwise by law or a written offer, consumed credits and completed processing are not refundable. You may stop using the service at any time. Amounts already due remain payable.
8. Acceptable use
You must not use HardToSkip to violate law, platform rules, intellectual property, privacy, publicity, or contractual rights; impersonate or deceive; distribute malware; exploit minors; generate unlawful sexual or violent material; harass protected groups or individuals; manipulate platform engagement dishonestly; bypass service limits; probe credentials; or interfere with service security and reliability.
9. Third-party services
HardToSkip integrates with services such as YouTube, infrastructure providers, media providers, payment services, Google Gemini, and OpenAI. Their own terms and policies apply to their services. HardToSkip is not responsible for a third-party service becoming unavailable or changing its rules.
10. Suspension and termination
We may suspend or terminate access when reasonably necessary to address nonpayment, misuse, security risk, legal requirements, or material breach. You may stop using the service and request account deletion. Provisions that should reasonably survive termination, including ownership, payment, disclaimers, and liability limits, will survive.
11. Disclaimers and liability
To the extent permitted by law, HardToSkip is provided on an as-available basis without warranties that every output will be accurate, suitable, uninterrupted, or commercially successful. Nothing in these terms excludes rights or liability that cannot legally be excluded.
To the extent permitted by law, HardToSkip will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of the service, generated content, platform enforcement, or third-party services. Any aggregate liability will not exceed the fees you paid to HardToSkip during the six months before the event giving rise to the claim.
12. General terms
If a provision is unenforceable, the remaining provisions continue. Failure to enforce a provision is not a waiver. You may not transfer these terms without consent, while HardToSkip may transfer them as part of a reorganization or sale. Applicable mandatory consumer protections and conflict-of-law rules remain in effect.
We may update these terms when the service or legal requirements change. Material updates may be communicated through the service or by email. Continued use after the effective date means you accept the updated terms.
